March 15 -- Effective Employment and Education Verification: How to Tell What Is Real and What Is Not Successful hiring decisions are critical in challenging economic times, and verifying past employment and education and obtaining references are essential to this process. Unfortunately, candidates falsifying or inflating employment and educational accomplishments has become a significant problem for employers. Legal limitations create barriers for HR professionals when obtaining and giving past employment information. Review legal and effective techniques for the reference checking process and how to verify education and spot phony credentials. Understand new technologies and approaches, and gain insight on international credentials and the role of Web 2.0.

To avoid bad hiring decisions, employers have increasingly turned to pre-employment background screening as a risk management tool. No screening program can be conducted without a full understanding of a number of laws, including the Fair Credit Reporting Act (FCRA), discrimination and privacy law, the ADA, and a host of state-specific rules. Review the application of federal and state laws to both pre-employment screening and the investigation of current employees.

Summary
NCHRA’s new HR Core: CA Edition e-Program is designed for professional and non-professional students with newly assigned HR responsibilities, those who are new to HRM in California, as well as those who simply want to better understand the legal and regulatory differences in the practice of HRM in California as compared to the rest of the country. The CA Edition e-Program focuses on the practice of HRM on a real-time, day-to-day basis with an emphasis on the basic legal and regulatory knowledge required to carry out one’s HR responsibilities in a competent manner. This program is available to anyone with an interest in California HRM.
Utilizing the capabilities of the Internet-based GoToWebinar platform, this web-based course is taught in interactive one-and-a-half hour sessions twice a week. The program is divided into two parts with five sessions in each part, 7 ½ hours learning time, or fifteen hours for the total program.
February 27 – Introduction and Overview
Introduce course material, webinar platform discussion, and participant introductions. Generally discuss the scope and focus of this program.
February 29 – Which laws apply in California
Review and discuss applicable California laws and regulations by employer size and industry applicable to employers; independent contractor or employee status. Discuss new laws effective January 1, 2012.
March 5 – Hiring practices
Discuss legally-compliant recruiting, testing, interviewing, and selection procedures. Review effective record-keeping techniques. Discuss I-9 procedures and California requirements.
March 7 – California wage and hour laws
Review California’s Wage Orders and regulatory requirements relative to wage payments, work hours, overtime, meal and rest breaks, special pay requirements, and enforcement and penalties.
March 12 – Exempt and Non-Exempt distinctions/review
Discuss the legal difference between non-exempt and exempt job status; review requirements for exempt job classifications; partial day absences for exempt employees; how to write a legally effective job descriptions.

Bill Kelly, SPHR- CA, is a Principal and HR Consultant for Kelly HR. Bill's professional background includes 22 years of HR leadership roles in corporate management and 15 years of HR consulting experience. His extensive HR experience includes staffing, compliance, compensation & benefits, training, safety, and government contract management. As an adjunct faculty member, Bill taught HR courses for U.C. Berkeley and currently teaches certification preparation courses for NCHRA. His past and present professional leadership activities include serving on the Board of Directors for SHRM, HRCI, NCHRA, and Marin County Personnel Commission.
